Liability Waiver:

By proceeding to purchase Mode Studio services, you agree to the Mode Studio Limited Terms & Conditions.

You acknowledge & agree that any of the exercise and additional services:

- are a recreational activity &;

- may involve strenuous physical activity including but not limited to, muscle strength & endurance training, cardiovascular conditioning & training, & other fitness or wellbeing activities including contrast therapy.

You confirm now, & each time you utilise a service from Mode Studio that you are in good physical condition & do not suffer from any known disability or condition which would prevent or limit your participation.

You confirm you fully understand that you may injure yourself through participation in some of the services & you release Mode Studio Limited & its officers, agents & employees from claims, demands & causes of action now or in the future, as a result of your voluntary participation in the services, to the maximum extent permitted by law.

Full Membership Terms & Conditions

Intro
By proceeding through to purchasing your package from Mode Studio, you confirm you have read & agree to abide by the Mode Studio Terms & Conditions at all times.

Duration:
For services that carry a minimum term of 7 days: Your membership will automatically renew every 7 days until cancelled. Cancel through the app, or by contacting us directly (hello@modestudio.co.nz).

For Services that carry a minimum term commitment of 3 months: Your membership will automatically renew for another 3-month minimum term at the end of your current contract. If you choose not to renew, we require 7 days written notice (email: hello@modestudio.co.nz).

For Services that carry a minimum term commitment 6 or 12 months: Once the initial Membership commitment period has passed, your Membership will remain active on a rolling weekly basis until cancelled. Cancel by providing 7-days written notice (email: hello@modestudio.co.nz).

Account Access & Responsibility:

Account Creation & Use:

To be able to access Mode Studio's products & services, you'll be required to create an online account. Sharing accounts without express permission is strictly prohibited. Account creation requires accurate & complete information. You, the account holder, bear sole responsibility for all activity under your account & must ensure password security. Promptly notify us of any security breaches or unauthorised account use.

Bookings:

The Mode Studio system allows bookings up to 30 days in advance. All group training sessions will have a limit on the person capacity, so booking is essential. While we strive to accommodate any unbooked members, participation remains contingent on availability.

Member Services & Password Security:

Member Services sign-up requires choosing a password for which you retain complete confidentiality. Sharing your account details, username, or password with any third party is strictly prohibited. Immediately notify Mode Studio of any suspected unauthorised account use or password access. Remember, you are solely responsible for all account activity.

Mode Studio Rules:

Mode Studio is a space where all members should feel safe and comfortable. Any breaches of the Mode Studio Rules may result in termination of your membership / revoking your access to our products & services. In the event of termination due to a breach of these rules. Mode Studio is not obligated to refund you for any services lost or no longer accessible.

Equipment:

Please report any damaged or malfunctioning equipment to us immediately.

Do not drop weights, dumbbells, or equipment not designed for it.

Attire & Hygiene:

Appropriate workout attire & footwear is required to use our services.

Food is not allowed in the Studio exercise area.

Bookings, Late Cancellations & No-Shows:

Bookings must be used as per the designated date & time slot at the time of purchase / booking. We understand that things come up, but to respect our trainers & fellow members, we require a minimum 12 hours notice for all class and appointment cancellations.

If you miss the cancellation window or don't show up without notifying us, the below policy will take effect:

Your credit will be used as though you had redeemed the service in full
You will be charged a $10 cancellation fee, charged the following day to your card details we have on file

Suspending Your Membership:

Mode Studio allows a Member to suspend your membership for a maximum period of 2 weeks at any one time. The duration of your membership’s commitment term increases by the same length of your suspension.

I.e.: If you suspend your membership for two weeks, your 3-month membership term is extended from 12 weeks to 14 weeks total.

Your Personal Health:

You confirm that you are in good physical health, & there is no reason (medical or otherwise) why you are unable to do active or passive exercise or engage in contrast therapy.

You acknowledge that the Mode Studio Team is not able to provide you with medical advice in respect to your fitness. Any instruction is offered as a guideline and it is your responsibility to assess the limitations of your abilities to partake in active or passive exercise or engage in contrast therapy.

You agree that Mode Studio & its Trainer(s), Staff Member(s) or Directors will not be liable in the event that injury occurs during a session.

Personal Belongings:

Mode Studio provides secure lockers for your convenience, the safekeeping of your personal belongings remains your sole responsibility. We assume no liability for any loss or damage that may occur.

Payment & Members Obligations:

You will be charged & the payment processed at the time of purchase. If the service is a recurring service, Mode Studio will charge Members ongoing on a weekly cadence for the duration of the purchased service. At the end of the duration, Mode Studio will continue to charge you on a weekly rolling basis unless notified otherwise.

As the member, you are responsible for ensuring your chosen payment method can accept recurring charges & remains valid throughout the duration of your agreement, even for third-party accounts linked to your membership. Additionally, you are responsible for fulfilling your minimum term of payments despite any unforeseen issues with your chosen payment method.

In the event of failed payments, Mode Studio will re-attempt processing your payment in 24 hours. If the payment fails a second time, new class or appointment bookings will be blocked until your account balance has been cleared. If payments fail as a result of invalid details, you will be liable for all associated fees & required to update your payment information promptly.

Credit card information is always encrypted when transferred over networks.

Termination of your Membership:

Termination by Member:

If you need to terminate your membership &:

- You are still within the duration of the membership: You’ll be required to pay 70% of the outstanding amount in full. You can do this by reaching out to hello@modestudio.co.nz to let us know of your wish to terminate your membership.

- You are outside the duration of the membership: You can do so by contacting Mode Studio via hello@modestudio.co.nz to have your membership cancelled by our team.

- You are less than 5 business days into your membership: You can terminate & will only be charged for the number of days you had the membership. Mode Studio will cancel any recurring charges & if applicable, refund any money owed. If you wish to do so, please ensure you email us on hello@modestudio.co.nz before the 5 business days have lapsed.

Termination by Mode Studio:

We may terminate your membership immediately if you carry out any activity which is illegal, offensive, dangerous to other people or to you, or if you act in serious breach of our rules, terms & conditions. If Mode Studio terminates because of you, the Member's actions, we will not be liable to you in any way and are not obligated to refund you for any payments paid for services no longer able to be utilised..
